To use Google Pay you must accept (1) the Google Terms of Service (the “Google ToS”), (2) these Google Pay/Google Payments Additional Terms of Service, and (3) the Google Payments User Policies.
Please read each of these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.
If these Google Pay/Google Payments Additional Terms of Service conflict with the Google Terms of Service, these Google Pay/Google Payments Additional Terms of Service will govern. If there is any conflict between the English-language version of the Terms and a version translated into another language, the English-language text shall prevail.
Our Privacy Policy and the Google Payments Privacy Notice describe how Google handles your payments information, and you agree that they apply to your use of our services. Please note that the Google Terms of Service applies to storing and using items such as loyalty cards, reward program cards, transit passes, boarding passes, and other non-payment items.
Google Pay is a 'Service' as defined in the Google ToS.
Certain Google Pay features were previously branded 'Android Pay'. While you may continue to see legacy references to Android Pay in shops, in apps or on websites, those features are subject to these Terms.
Please see the Google Pay Help Center for more information.
By agreeing to the Terms, you represent that you are:
You will also need a Google Account; a device that meets the Service's system and compatibility requirements, which may change from time to time; working Internet access; and compatible software. Your ability to use Google Pay, and Google Pay's performance, may be affected by these factors. Such system requirements are your responsibility.
To protect your Google Account, keep your password confidential and do not share your account details or password with anyone else. You should not reuse your Google Account password on third-party applications. Learn more about keeping your Google Account secure, including what to do if you learn of any unauthorized use of your password or Google Account.
If you’re under the age required to manage your own Google Account, you must have your parent or legal guardian’s permission to use the Service. Please have your parent or legal guardian read these terms with you.
If you’re a parent or legal guardian, and you allow your child to use the Service, then these Terms apply to you and you’re responsible for your child’s activity on the Service, including any transactions made by your child using the Service. You also represent that your child is the cardholder or an authorized user of any Payment Method saved to your child’s Google Account. Your child will at minimum need a device that meets the Service’s system and compatibility requirements, which may change from time to time; working Internet access; and compatible software, in order to use the Service.
Transaction Security
From time to time, Google Pay may provide you with various transaction security features to reduce the risk of unintended or unauthorized transactions involving your Google Account. Regardless of the transaction security features you select, you assume responsibility for all charges made through your Google Account, including unintended or unauthorized purchases made through Google Pay.
Google Pay saves the things you do in Google Pay (like your transactions and communications), and the things you keep in Google Pay (like your forms of payment), to your Google Account to provide the Google Pay Service to you. Google Pay allows you to manage various kinds of payment methods and transact with Google and third parties using things you keep in Google Pay.
We reserve the right to change, suspend or discontinue any aspect of the Google Pay Service at any time, including hours of operation or availability of the Services or any Service feature, without notice and without liability.
With Google Pay, you can keep and manage various kinds of payment methods in your Google Account (collectively, 'Payment Methods'), including:
Availability of a given Payment Method or its compatibility with Google Pay may depend on your Payment Method and other factors. The compatible Payment Method types, as well as the Payment Method uses and Google Pay features described below may not be available to you, and may change at any time.
You may be able to save a Payment Method to your Google Account through a variety of user interfaces. In order to save a Payment Method, you must complete required information on any registration forms presented to you. The information that you provide must be current, complete and accurate, and you must maintain it as such. We may require you to provide additional information as a condition of continued use of Google Pay, or to help us determine whether to permit you to continue using Google Pay.
When you save a Payment Method, Google may store information relating to the Payment Method, such as your name and billing address. Google also allows you to save other information to your Google Account that can help speed up transactions, such as a delivery address.
You authorize us to confirm that your Payment Method is in good standing with its provider, including, but not limited to, by submitting a request for a payment authorization and/or a low-value credit and/or debit to the Payment Method, in accordance with network rules or other requirements applicable to the Payment Method.
You agree that Google Pay is for your personal use, with your own Payment Methods. If you use Google Pay with an eligible corporate card, you agree that you are doing so with your employer's authorization and with the ability to bind your employer to these Terms.
You also agree that Google may update your Payment Method information, including your card name, card art, card number, expiration date, and other card-related information, based on information received from your card issuer and/or the payment networks under certain account update programs. Google may reflect these changes in your stored Payment Method information to help you identify your cards and prevent payment failure or service termination.
Except where Google or its affiliate is the issuer, neither Google nor its affiliates are a party to your Payment Methods' cardholder agreements, privacy policy or other terms of use. Nothing in these Terms modifies any such issuer terms. In the event of any inconsistency between these Terms and your issuer's terms or privacy policy, these Terms will govern the relationship between you and Google with respect to Google Pay, and your issuer's terms will govern the relationship between you and the issuer. Google does not make any representation or verify that any of your Payment Methods is in good standing or that the issuer of your Payment Method will authorize or approve any transaction with a merchant when you use Google Pay for that transaction.
Except where Google or its affiliate is the issuer, neither Google nor its affiliates are involved in issuing credit or determining eligibility for credit, nor do they exercise control over: the availability or accuracy of Payment Methods or funds; the provisioning (or addition) of Payment Methods to Google Pay; or addition of funds to Payment Method balances. For any concerns relating to the foregoing, please contact your Payment Method's issuer.
(d) Enabling or Saving a Virtual Card Number, Virtual Account Number, or Linked Third-Party Account
The following additional terms apply when using Google Pay to enable or save a Virtual Card Number, Virtual Account Number, or Linked Third-Party Account to your Google Account.
After you have begun to add a Payment Method to Google Pay and provided the information requested by Google and/or your Payment Method issuer, Google Pay will check whether the Payment Method is eligible to be used with Google Pay. All of a participating issuer's Payment Methods may not be eligible. If your Payment Method's issuer supports Google Pay and your Payment Method is eligible, when adding it you may see a screen asking you to accept the issuer's terms and conditions. Once you have done so and successfully added the Payment Method, Google Pay will enable or store a Virtual Card Number (or Virtual Account Number, where applicable) representing your Payment Card's actual card account number, or associate your Linked Third-Party Account with your Google Account, for use as described in the Terms. When choosing to use a particular Payment Method to complete a purchase, before doing so, you may see a screen(s) from your issuer asking you to accept the issuer's terms and conditions related to that purchase and any extension of credit from the issuer to finance that purchase.
Virtual Card Numbers that you register using Google Pay are distinct from any associated Payment Cards that you save to your Google Account and cannot be used for in-store Near-Field Communication ('NFC') transactions. However, when you register a Virtual Card Number, Google Pay may also save the associated Payment Card in your Google Account and it may be available for your use for other Google services.
You acknowledge that Google Pay may receive transaction information from your Payment Method's issuer, payment network, or payment service providers to display transaction details and your transaction history in Google Pay.
A Payment Method may be removed from Google Pay on a given device and become unusable with the Service if: (i) you delete the Payment Method from Google Pay; (ii) you delete the Payment Method from your Google Account; (iii) you erase your mobile device using Android Device Manager; (iv) you delete your Google Account; (v) your mobile device fails to connect to any Google product or service for 90 consecutive days; (vi) you do not use Google Pay on the device for 12 consecutive months; and/or (vii) your Payment Method's issuer or payment network instructs Google to remove the Payment Method from Google Pay. When turned off in Google Pay, a Virtual Card Number that you have previously saved as a “card-on-file” with a merchant may still be available for that merchant to charge based on the arrangement between your payment issuer and the merchant.
Google Pay may allow you to initiate a payment transaction with a 'Seller', defined as (i) a Google group company or (ii) any other seller participating in one or more of Google's marketplaces (as listed here) that offers merchandise, goods or services for sale to you, and that requests Google or its affiliates to process payment transactions on its behalf.
You acknowledge and agree that your transaction with a Seller (a 'Google Transaction') is solely between you and the Seller. Google and its affiliates are not party to your Google Transactions and related purchases, nor a buyer or seller in connection with any Google Transaction, unless expressly designated as such (for example, in the listing or description of the relevant merchandise, good or service on a Google-operated website or interface).
When you initiate a Google Transaction, Google may present your available and eligible Payment Methods to you at the time of transaction. Not all Payment Methods are eligible for use for all transactions. After you select the Payment Method that you wish to use, Google may charge that Payment Method, or may share the Payment Method and related details with one of its affiliates, which will then process the transaction on behalf of the Seller. You authorize the charge or debit to your Payment Method as necessary to complete processing of a Google Transaction. You also authorize any crediting to your Payment Method in connection with reversals, refunds or adjustments related to a Google Transaction.
For details or terms relating to a specific Google Transaction, including refund or dispute resolution policies, please refer to the terms of service, help center or other support materials provided by the Seller with which you transacted.
If there is a problem charging your selected Payment Method, Google may charge any other valid Payment Method that you have saved to Google Pay. Visit the Google Pay payment methods on the Google Wallet website, Google settings on your Android device, or Google account to manage your payment options. You also agree that a Seller may resubmit a Google Transaction for a purchase to the payment network for processing one or more times in the event that a prior Google Transaction is declined or returned by the payment network. Google may delay payment processing of suspicious transactions or transactions that may involve fraud, misconduct or violate applicable law, the Terms or other applicable Google policies, as determined at Google's sole and absolute discretion.
If a Seller offers you the ability to pay for subscriptions, your subscription will start when you click 'accept and buy' (or an equivalent phrase) on a subscription purchase. This is a recurring billing transaction. Unless otherwise stated, your subscription and the relevant billing authorization will continue indefinitely until cancelled by you. By clicking 'accept and buy' (or equivalent), you authorize the Seller to bill your chosen Payment Method each designated billing period for the subscription. The Google Transaction amount is subject to change by the Seller during the subscription period. Unless otherwise stated in the terms and conditions accompanying your subscription purchase, cancellation of a subscription will not become effective until the end of the current billing period, and you will not receive a refund for the current billing period and will continue to be able to access the relevant subscription for the remainder of the current billing period. In the event of a conflict between the terms and conditions you agree to for your subscription purchase and these Terms, the terms and conditions you agree to for your subscription purchase will govern.
When you initiate a payment using Google Pay with any party other than a Seller (such party is a 'Third Party' and such transaction is a 'Third-Party Transaction'), Google may pass details of your eligible Payment Method and related information to the Third Party or its payment processor so that it can charge your Payment Method. Depending on the nature of the Third Party, a Third-Party Transaction may be for the purchase of goods or services or for other purposes, such as charitable donations or gifts. A Third-Party Transaction may be initiated when you: use tap to pay in shops using NFC, barcodes or other contactless technology; select 'Google Pay' or 'Buy with Google Pay' (or comparable language) as a payment option in an online transaction on the Third Party's website or app; interact or transact with the Third Party on Google Pay; or transact with the Third Party through some other online interface, such as via the Google Assistant. When you initiate an online transaction, Google Pay may also share other information, such as a phone number, billing, delivery or email address saved in your Google Account, where relevant to completing the transaction.
In a Third-Party Transaction, after passing the Payment Method and other details to the Third Party or its payment processor, Google will have no further involvement in the transaction (except that the Third Party or its payment processor may pass order information back to Google for display in Google Pay), and you acknowledge and agree that such transaction is solely between you and the Third Party and not with Google or any of its affiliates. You should contact the Third Party or your Payment Method provider (for example, the issuer of your Payment Card) directly regarding any issues with Third-Party Transactions, including refunds and disputes.
(c) As part of Chrome or Android AutoFill
If you have enabled the 'AutoFill' feature on the Google Chrome browser or on your Android device, Google Pay may also present you with the option of automatically filling your saved Payment Method and address information in a Third-Party website's payment form on the Chrome browser, or in a Third-Party app's payment form on an Android device. (For more information on how AutoFill works with Google Pay, consult the Chrome Help Center). When you use this feature, Google is not interacting with the Third-Party website or app, and is only completing your request to automatically fill certain selected information in a Third-Party form. Google has no involvement in any transaction that you complete using Chrome or Android AutoFill, and you acknowledge and agree that such transaction is solely between you and the Third Party and not with Google or its affiliates. You should contact the Third Party or your Payment Method issuer directly regarding any issues with a transaction in which you used Chrome or Android AutoFill.
(d) For Google Payment Services
If you choose to participate in GPC Services, Google may present your available and eligible Payment Methods to you at the time of a transaction and may pass your Payment Method details to Google Payment Corp. (‘GPC’) for it to charge/debit your Payment Method for the GPC Services, as discussed below in the GPC Services sections of these Terms.
When you visit a participating third party's website or app, Google may disclose to the third party whether or not you have Google Pay set up on your device if requested by the third party, so that the third party knows whether to offer you Google Pay as a payment option. However, you may still see the Google Pay payment option on a third party’s website or app if the third party offers Google Pay as a payment option to all users. You can opt out of Google making this disclosure in Google Pay privacy settings. Opting out could affect your ability to use Google Pay with certain third parties. If you’re under the age required to manage your own Google Account, this does not apply to you and Google won’t disclose your information for this purpose.
(f) Fraud Prevention Services and Risk Scores provided by Google Pay
When you visit a participating third party's website or app, Google may share fraud risk scores and provide other fraud prevention services to such third parties. Specifically, Google may disclose numeric fraud risk scores and other fraud assessments (which are calculated using historic and current user information collected by Google Pay) to the third party, solely for their fraud and abuse prevention purposes.
Google Payment Corp. (‘GPC’), a subsidiary of Google LLC, offers or facilitates various products and services (the ‘GPC Services’), described in the following sections. The sections of these Terms which relate to specific GPC Services govern your access and use of those GPC Services to the extent you participate in the specific GPC Service discussed in that section. In the event of a conflict between the GPC Services provisions of these Terms and the Google Pay provisions of these Terms or the Google ToS, the GPC Services provisions of these Terms will prevail.
These GPC Services Terms are divided into the following parts:
B. Google Payment Corp. Services
2. Balance in Google Wallet Service
4. Processing Service for Third Parties
5. Subscription Purchases And Other Recurring Payments
6. Store Credit - Eligibility and Redemption
7. General Terms Applicable to GPC Services
Exhibit A. Google Pay Balance Short Form Disclosures
Exhibit B. Google Pay Balance Long Form Disclosures
Exhibit C. Balance in Google Wallet Long Form Disclosures
By opening a Google Pay account and accepting these Terms, you agree that this Section titled “Google Pay Balance Service” applies in the event that you participate in Google Pay Balance-related activity, as described below.
You must be eighteen (18) years of age or older, a resident of the United States, and otherwise meet the requirements in these Terms, in order to participate in the Google Pay Balance Service.
A Google Pay Balance represents stored value funds maintained by GPC on your behalf in connection with your Google Pay account. This Section of the Terms (titled “Google Pay Balance”) only applies to you if you request to activate or hold a Google Pay Balance.
Unless you activate a Google Pay Balance, funds received and held by us in connection with your Google Pay account do not represent a store of value, and you may not access or use any such funds except to withdraw the funds to your ACH-enabled checking or savings account via the ACH network or checking account using your debit card.
If you wish to add any money to or use the funds accumulated for you and held by us to purchase transactions with merchants, you must activate a Google Pay Balance in accordance with these Terms.
(a) Acceptable Use
All users of the Google Pay Balance Service agree to the restrictions contained in the Google Payments User Policies. Any use of the Google Pay Balance Service which violates the requirements of the Google Payments User Policies may result in a user being suspended from using the Google Pay Balance Service and/or other Services. The Google Pay Balance Service may not be used for charitable transactions except in cases where such charities are presented by Google as merchants accepting Google Pay Balance as a Payment Method on Google Pay.
(b) Funding
You will need to select a Payment Method to be used as your funding account for the Google Pay Balance Service (‘Funding Account’) which may be a debit card or ACH-enabled checking or savings account or other Payment Method that we support. See Exhibit A, Short Form Disclosures and Exhibit B, Long Form Disclosures regarding any applicable fees. The fees specified on those Disclosures apply regardless of whether we have activated a Google Pay Balance for you.
You authorize us to confirm that your Funding Account(s) are in good standing with the issuing financial institution, including by submitting a request for a payment authorization to the Funding Account or by saving a Virtual Card Number for your Funding Account instrument. If we utilize a third party service to verify your Funding Account that requires your registration with or requires you to provide information to the third party service, we will provide you with details regarding that service, and we may seek your consent prior to the verification.
Some Funding Accounts may not be available for all transactions, such as if you are attempting to purchase goods or services from a merchant that does not accept a given Funding Account.
(c) Linking a Funding Account and Verification
We may offer you the option of linking a Funding Account through the use of a third party company’s service, which Google does not control. You may be required to register and sign-up for such third party service, and accept any terms and conditions or privacy policy that the third party requires. The third party service may require you to provide your login credentials for the financial institution account that you wish to link. In this case, you are authorizing the third party to access your account in order to verify it and for any other purposes which may be identified in the third party’s terms and conditions or privacy policy, and to send to us your account number and routing number, along with other verifying information which may include your name, address, and phone number associated with the financial institution account, as well as any other information you have authorized the third party to share with us.
You may remove the Funding Account from your Google Pay account to unlink it from Google Pay, and once removed, we will no longer receive your account-related information from the third party.
(d) Activating Google Pay Balance and Identifying Information
Upon activating a Google Pay account, without activating a Google Pay Balance, you may receive funds from certain sources we may permit from time to time, which you may withdraw to a permitted Payment Method.
If you wish to activate a Google Pay Balance or are requested by us to do so, you will be required to submit additional identifying information to us (in addition to that provided to create your Google Pay account), which we must then verify prior to activating your Balance. When we request that you activate a Google Pay Balance, we may ask you to provide identifying information for that activation under certain circumstances, for example to comply with applicable law or regulation.
In certain cases, we may require such identifying information and that you activate a Google Pay Balance for you to continue using Google Pay. If you decline to provide such identifying information or we are unable to verify such information, we may decline your attempted transaction or suspend your Google Pay or Google account. If we suspend your Google Pay or Google account, we will provide any held funds to you to the extent permitted by law.
To activate a Google Pay Balance, the additional identifying information that you must submit includes your full name, your address, date of birth, and the last four digits of your social security number. If we are unable to verify your information, we may ask you to provide supplemental identifying information, which may include a photo of a qualifying government ID, self-portrait photo, proof of address documentation, the full nine digits of your social security number, or other information or documentary proof of identity that we may request.
Even if you submit the required additional identifying information and we are able to verify it, we may not activate a Google Pay Balance for you, in our sole and absolute discretion.
Any identifying information, including supplemental identifying information, that you provide to us for purposes of activating your Google Pay Balance will be used by us to verify your identity, and on an ongoing basis to protect you and us from fraud or abuse, including for review of high risk transactions, and to protect against account takeover or compromise of your Google Pay account. We may also use such information, with your additional consent, to help you register for products and services that you request from us or certain third parties.
(e) Using Google Pay Balance
Once activated, you may access your Google Pay Balance for the activities permitted by us from time-to-time and any funds associated with your Google Pay account will automatically be converted to a Google Pay Balance.
You may not “split” Payment Methods for a single transaction with your Google Pay Balance (for example, you cannot fund part of a transaction with Google Pay Balance and part with a linked ACH-enabled checking or savings account).
You may also add funds to your Google Pay Balance using your linked ACH-enabled checking or savings account, debit card or other Funding Accounts then supported for the Google Pay Balance Service. See Exhibit A, Short Form Disclosures and Exhibit B Long Form Disclosures regarding any applicable fees.
You may also use your Google Pay Balance through Google Pay as a Payment Method for purchases of certain goods or services from Google, Google affiliates or participating merchants. When used as a Payment Method, GPC’s role is limited to remitting the value of the agreed payment to the merchant. Please refer to the merchant’s site or policies for customer service, disputes or refunds regarding the goods or services purchased.
You may withdraw your Google Pay Balance to your linked ACH-enabled checking or savings account or debit card. See Exhibit A, Short Form Disclosures and Exhibit B Long Form Disclosures regarding any applicable fees. The fees specified on those Disclosures apply regardless of whether we have activated a Google Pay Balance for you.
Using your Google Pay Balance in order to monetize/maximize any rewards programs offered under the issuer's terms for your credit or debit card is prohibited under these Terms.
(f) Instant Transfer Evaluation for Faster Transfers
We may also offer you the ability to qualify for faster transfers (including depositing funds into your Google Pay Balance) from a linked ACH-enabled checking or savings account (‘Instant Transfer Evaluation’). Instant Transfer Evaluation enables funds transferred from your Funding Account to be accessible to you for depositing into your Google Pay Balance prior to the final settlement of such funds with us. However, you are ultimately responsible to us for the full and final settlement amount of such funds authorized through Instant Transfer Evaluation. Instant Transfer Evaluation may include your authorization of a third party service to access and provide us with the current balance of your Funding Account in order to make an eligibility determination for each funding transaction using such Funding Account. Instant Transfer Evaluation may be offered as an option for which you must separately consent, or may be included as part of linking a Funding Account in which case you will be required to consent to Instant Transfer Evaluation with the linking of a Funding Account.
We do not receive the login credentials for your financial institution account, and do not directly access your account with your financial institution.
If you have linked a Funding Account that qualifies for Instant Transfer Evaluation, you agree that faster transfers are not guaranteed for any funding transaction that you initiate, and such qualification depends on factors that may include the then-current balance of your Funding Account, the amount you request to send, and recent Google Pay activity. If a funding transaction does not qualify for faster transfers, we will present you with options which may include to proceed with the Funding Account chosen without faster transfer, to select another Funding Account (if applicable), or to cancel the funding transaction.
(g) Closure of Balance
If you choose to close your Google Pay Balance, you will no longer be able to make purchases from merchants using your Google Pay Balance. Any funds received for you after closure of your Google Pay Balance will be held by us and may be transferred via an ACH transaction to an ACH-enabled checking or savings account.
1.2 General Terms Applicable to Google Pay Balance
(a) Withdrawal of Funds
You may register an ACH-enabled checking or savings account or a debit card to withdraw funds to the associated bank account from your Google Pay Balance or, if you do not have a Google Pay Balance, which we are holding for you. If you are permitted by GPC to withdraw funds to a bank account or debit card, you must be the named account-holder of both the Google Pay account and the bank account or debit card to which funds are withdrawn.
Withdrawals may be processed in part by third parties (such as your account-holding bank). We are not responsible for withdrawn funds once provided to the third party for delivery to you at your request. GPC charges no fees for withdrawals to ACH-enabled checking or savings accounts, but may charge fees for withdrawals via debit card. See Exhibit A, Short Form Disclosures and Exhibit B, Long Form Disclosures for any applicable fees. The fees specified on those Disclosures apply regardless of whether we have activated a Google Pay Balance for you.
You are solely responsible for any fees that may be charged to you by a third party for processing a withdrawal. GPC will not be responsible for withdrawals provided to the wrong party or account, or where you provided incorrect withdrawal account details to GPC.
(b) Liability for Failure to Make Transactions
We may restrict access to your Google Pay account or Google Pay Balance temporarily or permanently if we notice potentially suspicious activity in connection with your use of the Service(s), or other potential violations of the Google Payment User Policies. We have no liability for restricting such access because of potential suspicious activity.
If we do not complete a payment transaction on time or in the correct amount according to our agreement with you (other than for restrictions because of suspicious activity), we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
(i) If through no fault of ours, a merchant refuses to accept or honor a transaction using your Google Pay Balance or other Payment Method;
(ii) If through no fault of ours, you do not have enough money available in your Google Pay Balance or other Payment Method to make a purchase;
(iii) If the terminal or system was not working properly, and you knew about the breakdown when you started the transaction;
(iv) If the transaction information supplied by you or a third party is incorrect or untimely;
(v) If circumstances beyond our control (such as flood or fire) prevent a transaction, despite reasonable precautions that we have taken;
(vi)The merchant authorizes an amount greater than the purchase amount;
(vii) If there is a hold or your funds are subject to legal process or other encumbrance restricting their use;
(viii) If we have reason to believe the requested transaction is unauthorized; or
(ix) If you are not a U.S. resident, do not create a Google Pay account or do not take any other required actions necessary to complete a transaction.
There may be other applicable exceptions as otherwise provided in our agreement with you or by state or federal laws.
(c) Transaction Records, Customer Service and Error Resolution Policy
Records of your Google Pay Balance transactions(your ‘GPC Services Transactions’) will be reflected in your transaction history in your Google Pay account.
In addition, you will be provided with a statement of your GPC Services Transactions each month that transaction activity has occurred or quarterly, if no transaction activity has occurred, which can be accessed at payments.google.com. You are responsible for reviewing your statement and transaction activity to determine if there are any errors or unauthorized transactions, and for alerting GPC of such events, in accordance with our Customer Service and Error Resolution Policy. You should review the Customer Service and Error Resolution Policy to understand certain rights you may have as to your GPC Services Transactions.
It is your obligation to save or print a copy of your GPC Services Transactions statement. If your access to one or more Services is cancelled or terminated by you or by us for any reason, you will not be permitted to access statements stored by GPC. You may request paper copies of certain electronic records about your account and stored by GPC, subject to the limitations of the Electronic Communications policy, as stated in Section 6.15 below. GPC reserves the right to charge you fees for such paper copies.
Your Google Pay account will be deemed inactive if you have not had a Google Pay Balance transaction within the prior six (6) months. Accordingly, you will not be provided with a monthly statement of your GPC Services Transactions until you have had your first GPC Services Transaction through your Google Pay account. You also will not be provided with a periodic statement if six (6) months have passed since your last GPC Services Transaction through your Google Pay account. If your Google Pay account has become inactive because six (6) months have passed since your last GPC Services Transaction and your Google Pay account has not been closed, your Google Pay account will be reactivated and periodic statements of your GPC Services Transactions will again be provided to you following a GPC Services Transaction through your Google Pay account.
(d) Transaction and Account Limits
Without Activated Google Pay Balance
With Activated Google Pay Balance
Upon activating a Google Pay Balance:
Additional/Different Limits
GPC may with or without notice to you impose additional or different limitations on the dollar amount or frequency of any transactions or withdrawals permitted.
GPC may place additional limits on individual transactions or accounts if we detect potentially high risk or fraudulent activity. Such limits may require that you provide additional identifying information to verify your identity or the transaction or account before you may complete the transaction or use the Service.
(e) Confidentiality
In addition to other disclosure reasons which may be stated in these Terms and the Google Payments Privacy Notice, we will disclose information to third parties about your Google Pay account, Google Pay Balance, other Google Pay Balance transactions you make:
(i) Where it is necessary for completing the Google Pay Balance transaction;
(ii) In order to verify the existence and condition of your Google Pay account or Google Pay Balance, for a third party, such as a credit bureau or merchant;
(iii) In order to comply with government agency or court orders; or
(iv) If you give us your permission.
(f) Your Authorizations
(1) You authorize GPC to initiate any subsequent credit, debit or charge to your Funding Account or to your Google Pay Balance (if applicable to you) in order to process a return, chargeback, reversal, refund, adjustment or rejection.
(2) In the event that you sign up for a successor GPC account and your Google Pay Balance is thus closed, you agree that we may, with your consent, debit your successor GPC account for any existing or recurring payments, or initiate any credit, debit or charge to your successor GPC account (as your successor service to the Google Pay Balance) to process any return, chargeback, reversal, refund, adjustment or rejection, to correct an error relating to, or to resubmit any payments initiated before your Google Pay Balance is closed.
(3) Your authorizations under this Section remain in effect while you are a user of the Services and for a period of ninety (90) days following termination or cancellation of the Services.
(g) Fees
GPC may charge fees in accordance with the then-current fee schedule, as stated herein. See Exhibit A, Short Form Disclosures, which provides a summary fee disclosure and Exhibit B, Long Form Disclosures. Any fees specified on those Disclosures apply regardless of whether we have activated a Google Pay Balance for you.
Please review the account terms provided by the issuer of your Funding Account for any fees it may assess on your use of your Funding Account.
A Balance in Google Wallet is a type of Google Pay Balance provided by GPC which Family Managers in Google Family Link can establish and can permit an eligible supervised user in their Google Family Link account (a “Supervised User”) to be an authorized user of the Balance in Google Wallet. The Family Manager is the legal owner of the Balance in Google Wallet and is responsible for purchases that are funded with the Balance in Google Wallet. This Section of the Terms (titled “Balance in Google Wallet Service”) applies to you if you request to create or otherwise hold or maintain a Balance in Google Wallet.
A Family Manager may set up more than one Balance in Google Wallet, each for different Supervised Users. If eligible, an individual may have both Balance in Google Wallet balances and an unsupervised Google Pay Balance.
As a type of Google Pay Balance, a Balance in Google Wallet is subject to the provisions applicable to Google Pay Balances under these Terms. However, to the extent that there is a conflict between this section and other provisions of these Terms related to Balance in Google Wallet, this section governs.
By creating a Balance in Google Wallet, you acknowledge and agree to these Terms, the Privacy Policy and the Google Payments Privacy Notice, including the Google Teen Privacy Guide and the Google Payments Privacy Guide for Children, on behalf of yourself and any Supervised User.
(a) Eligibility to Create and Maintain a Balance in Google Wallet
In addition to the eligibility requirements otherwise specified in these Terms and other conditions we may establish from time to time, in order to create and maintain a Balance in Google Wallet you must:
(i) be a designated Family Manager on Google Family Link;
(ii) have/create your own Google account and payments profile that is in good standing;
(iii) ensure that the Supervised User has an eligible device with a lock screen feature enabled;
(iv) have a Supervised User linked to your Google Family Link account that is (a) under eighteen (18) years of age at the time the Balance in Google Wallet is established and (b) a U.S. resident; and
(v) satisfy applicable identity verification requirements.
Your ability to create and maintain a Balance in Google Wallet is subject to our approval, in our sole discretion, and your ability to meet our eligibility requirements.
We may request that you provide information to assist us in verifying your identity and creating the Balance in Google Wallet. You authorize us to collect, verify and use identifying information about yourself, including your full name, address, date of birth, and Social Security Number, and the Supervised User, including their full name and address, in connection with the creation and use of the Balance in Google Wallet and in accordance with our Privacy Policy and the Google Payments Privacy Notice. We will request that you provide information about the Supervised User as part of the Balance in Google Wallet creation process. You represent that the information you provide to us is current, complete and accurate, and you must maintain it as such.
If we are unable to verify your information, we may ask you to provide supplemental identifying information, which may include a photo of a qualifying government ID, self-portrait photo, proof of address documentation, or other information or documentary proof of identity that we may request. If you fail to provide this information or we are unable to verify your identity, we may decline to create or may close your Balance in Google Wallet.
(b) Creation of a Balance in Google Wallet
By requesting to create a Balance in Google Wallet, you authorize us to establish a Balance in Google Wallet, for which the Supervised User that you designated during the Balance in Google Wallet creation process will be an authorized user. You, as the Family Manager, are the sole legal owner of the Balance in Google Wallet, and are financially responsible for transactions that are funded using a Balance in Google Wallet. All funds held in the Balance in Google Wallet are owned by you as the Family Manager, and are not owned by the Supervised User.
By requesting to establish a Balance in Google Wallet, you authorize us to share information related to the Balance in Google Wallet with the associated Supervised User and any individual designated as a parent in your Google Family Link account (the “Secondary Parent”) (if one has been designated in your Google Family Link account). This includes information related to funds added and transferred from the Balance in Google Wallet, use of supervisory tools and closure of the Balance in Google Wallet. As further detailed below, Secondary Parents will also be able to utilize certain controls related to the Balance in Google Wallet.
(c) Issuance of a Google Pay Balance Prepaid Visa® Card
When you create a Balance in Google Wallet, you authorize us to share your information with Pathward®, N.A., Member FDIC to enable the bank to establish a prepaid account (the “Card Account”) for you. See your Cardholder Agreement (as defined below) for more details. Your Card Account also comes with virtual Google Pay Balance Prepaid Visa® Card(s) (each a “GPBP Card”), issued by Pathward®, N.A., pursuant to a license from Visa U.S.A. Inc., for use by your Supervised User(s), as an authorized user of your Card Account, to access funds within the Supervised User’s associated Balance in Google Wallet. Each GPBP Card (a “balance-linked payment method”) is linked to the Balance in Google Wallet associated with the Supervised User. Each time a Supervised User makes a purchase using the GPBP Card, subject to these Terms and the Cardholder Agreement, funds will be transferred from the Balance in Google Wallet associated with the Supervised User to your Card Account to fund the purchase transaction made with the GPBP Card. During the Balance in Google Wallet set-up process and after set-up, as part of the Balance in Google Wallet supervisory tools, you and the Secondary Parent will be able to select which device(s) you would like the Supervised User’s GPBP Card to be provisioned to. A GPBP Card may not be provisioned to the eligible device of any individual aside from devices of the associated Supervised User.
Once the GPBP Card is provisioned to the Supervised User’s device(s), the Supervised User can use the GPBP Card in their Google Wallet to make in-store tap to pay purchases from U.S. merchants accepting the GPBP Card wherever contactless Visa® debit cards and Google Pay are accepted. GPBP Card is valid only in the US. No ATM or cash access. The GPBP Card accesses funds held in your Card Account, which is, in turn, loaded with funds from your Balance in Google Wallet, at the time a purchase is initiated using a GPBP Card, provided that you have sufficient funds in your Balance in Google Wallet to cover the transaction and any applicable fees/taxes. Accordingly, sufficient funds must be available in the Balance in Google Wallet associated with the particular Supervised User in order for the associated Supervised User to make a purchase using a virtual GPBP Card.
For additional information related to your Google Pay Balance Prepaid Visa® Card, issued by Pathward®, N.A., Member FDIC, see the Google Pay Balance Prepaid Visa® Cardholder Agreement (the “Cardholder Agreement”).
The Cardholder Agreement is between you and Pathward®, N.A. not GPC or an affiliate of Google, and in the event of any conflict between these Terms and the Cardholder Agreement, with respect to your Card Account or GPBP Card, the Cardholder Agreement governs your Card Account and GPBP Card and your relationship with Pathward®, N.A., Member FDIC.
Pathward®, N.A. is the issuer of the Card Account and GPBP Cards only, and is not a party to these Terms and shall have no responsibility or liability to you except as expressly set forth in these Terms or the Cardholder Agreement.
(d) Designation of a Supervised User as an Authorized User of the Balance in Google Wallet
By designating a Supervised User that is associated with a Balance in Google Wallet during the Balance in Google Wallet creation process, you authorize that Supervised User to be an authorized user of the Balance in Google Wallet and the funds in such Balance in Google Wallet.
Accordingly, unless otherwise specified in these Terms, we will assume that you, as the Family Manager, have authorized all transactions involving the Balance in Google Wallet, including transactions where the Balance in Google Wallet is used to fund purchases with a balance-linked payment method, and you will be liable for all transactions and fees incurred on the Balance in Google Wallet.
To remove the Supervised User as an authorized user of the Balance in Google Wallet, you must close the Balance in Google Wallet for that Supervised User, as specified in these Terms. A Balance in Google Wallet that does not have an associated Supervised User will be promptly closed along with the GPBP Card associated with such Balance in Google Wallet.
(e) Multiple Balance in Google Wallet Balances
Subject to our eligibility requirements, you may create a Balance in Google Wallet balances for multiple Supervised Users that are associated with your Google Family Link account. A Family Manager may not have more than five (5) associated Balance in Google Wallet balances at any point in time. We may, in our sole discretion and at any time, further limit or increase the number of Balance in Google Wallet balances that you are permitted to maintain.
Each Balance in Google Wallet you create may only have one associated Supervised User and can solely be used by the Supervised User designated by the Family Manager. A Supervised User of a Balance in Google Wallet is prohibited from owning or being an authorized user of another Google Pay Balance, including another Balance in Google Wallet. The sharing of a Balance in Google Wallet with or use by any other person or user is strictly prohibited.
(f) Adding Funds to a Balance in Google Wallet
Only the 1) Family Manager, and 2) the Secondary Parent (if one has been designated) may add funds to an associated Balance in Google Wallet. A Supervised User cannot add funds to a Balance in Google Wallet.
In order to add funds to a Balance in Google Wallet, the Family Manager or Secondary Parent, as applicable, will need to select a Payment Method to be used as the Funding Account at the time they initiate a transfer, which may be a debit card or ACH-enabled checking or savings account or other Payment Method that we may permit. Instant (same day) debit card transfers are subject to additional provisions under these Terms. (See above subsections entitled “Instant Transfer Evaluation for Faster Transfers” and “Linking a Funding Account and Verification” for additional information.) See Exhibit C, Balance in Google Wallet Long Form Disclosures regarding any applicable fees. The fees specified on those disclosures apply regardless of whether we have activated a Balance in Google Wallet for you. A Google Pay Balance cannot be used as a Funding Account to add funds to a Balance in Google Wallet.
By initiating a transaction to add funds to a Balance in Google Wallet, you, as the Family Manager or Secondary Parent, authorize us and/or our applicable third-party service providers, to charge or debit your selected Funding Account for the total amount of the transfer, including without limitation all applicable fees and taxes. You will have the ability to choose which Funding Account is used to fund the transfer, however, we may determine the order of the Funding Accounts displayed in your Google Pay account and availability to be used to fund the requested transfer. You authorize GPC to initiate any subsequent credit, debit or charge to your Funding Account in order to process a return, chargeback, reversal, refund, adjustment or rejection, to correct an error relating to, or to resubmit a transfer. Your authorizations under this Section remains in effect while you are a user of the Services and for a period of ninety (90) days following termination or cancellation of the Services.
You will not have access to funds in the process of transmission to the Balance in Google Wallet. GPC reserves the right (but is not obligated) to make funds available to a Balance in Google Wallet before GPC receives final settlement of the Family Manager or Secondary Parent’s funding transaction. GPC also reserves the right in its sole discretion to delay transfer of funds to a Balance in Google Wallet or place a hold on funds received in the Balance in Google Wallet.
A Family Manager seeking to remove the ability of the Secondary Parent to add funds to the Balance in Google Wallet may do so by removing the Secondary Parent from the associated Google Family Link account.
(g) Settlement of Funds Transferred to a Balance in Google Wallet
A requested transfer to a Balance in Google Wallet is complete when funds are credited to the Balance in Google Wallet or reflected in the Balance in Google Wallet interface, and are available for use by the Supervised User. The Family Manager or Secondary Parent that initiated a transfer may request that GPC cancel the transfer prior to completion, by contacting GPC via our Contact Us page, or by calling 1-888-986-7944. GPC will use commercially reasonable efforts to cancel the transfer upon request by the Family Manager or Secondary Parent, as applicable. In the event that GPC is able to cancel the transfer, the funds will be recredited to the sender’s Funding Account that was used to fund the transfer to the extent possible. GPC may deduct applicable fees from the recredited funds, to the extent permitted by applicable law. Fund transfers that have been completed as set forth in this subsection are ineligible for cancellation.
If we are unable to complete the transfer to the Balance in Google Wallet for any reason, including because the Balance in Google Wallet has been closed, the transfer will be canceled and the funds will be recredited to the Family Manager or Secondary Parent’s Funding Account, as applicable.
Notwithstanding the foregoing, GPC will use commercially reasonable efforts to make funds available to a Balance in Google Wallet no later than three (3) business days after GPC receives final settlement of the Family Manager or Secondary Parent’s funding transaction. Except as set forth in the Customer Service and Error Resolution Policy, GPC has no liability to you or any other person for any delay in making funds available to the Balance in Google Wallet.
(h) Use of a Balance in Google Wallet
A Balance in Google Wallet may only be used to load funds in the value of U.S. dollars to your Card Account held by Pathward®, N.A. in order to fund in-store tap to pay transactions made using a GPBP Card. Once your funds held by GPC are transferred to your Card Account, Pathward®, N.A. facilitates your payment to the merchant. A Family Manager or Secondary Parent cannot approve in advance a transfer from a Balance in Google Wallet to a Card Account to fund a tap to pay purchase made with a balance-linked GPBP Card.
At the time an in-store tap to pay transaction is initiated using an associated balance-linked GPBP Card, you authorize us to i) debit your Balance in Google Wallet for the amount of the purchase plus any fees/taxes, and ii) transfer funds held by GPC to your Card Account held by Pathward®, N.A., Member FDIC, for the amount of U.S. dollars required to complete the purchase transaction and pay any applicable fees/taxes. If your Balance in Google Wallet does not contain sufficient funds to pay the purchase amount plus applicable fees/taxes, the transaction will be declined and no funds will be loaded to your Card Account. See Exhibit C, Balance in Google Wallet Long Form Disclosures regarding any applicable fees for transfers of Balance in Google Wallet funds to your Card Account and the Cardholder Agreement, for information on your Card Account and any applicable GPBP Card fees.
You, as the Family Manager, acknowledge and agree that the ability to fund purchases using a Balance in Google Wallet is limited to purchase and other transactions which are approved by GPC. We may prevent the Balance in Google Wallet from being used to fund purchases from certain merchants that are not appropriate for children (i.e. purchases of alcohol). Approval of Balance in Google Wallet funds transfers by GPC does not mean that there is sufficient funds in a Balance in Google Wallet to pay for the GPBP Card transaction.
(i) Limits on the Use of a Balance in Google Wallet
In addition to the limits described above and otherwise in these Terms, the Google Payments User Policies and the Cardholder Agreement, a Balance in Google Wallet may not:
For purposes of clarity, the Balance in Google Wallet may only be used to make in-store tap to pay purchases from U.S. merchants accepting the GPBP Card wherever Visa® and Google Pay are accepted. We may freeze your Balance in Google Wallet, if we suspect irregular, unauthorized or unlawful activities may be involved with the Balance in Google Wallet, pending an investigation of such suspected activities. If we freeze your Balance in Google Wallet, we will give you, as the Family Manager, any notice required by law.
Holds
With certain types of purchases (such as those made at restaurants, or similar purchases), your GPBP Card may be “preauthorized” for an amount greater than the transaction amount to cover gratuity or incidental expenses. Any preauthorization amount will place a “hold” on your available funds in your associated Balance in Google Wallet to be transferred to the Card Account until the merchant sends Pathward®, N.A., the final payment amount of your GPBP Card purchase. Once the final payment amount is received, the preauthorization amount on hold will be removed and funds in the final payment amount of the transaction plus any fees will be transferred from your Balance in Google Wallet for loading to your Card Account to settle the transaction. You will not have access to preauthorized amounts.
If a Supervised User’s transaction is authorized and then the Supervised User fails to make a purchase of that item as planned, the authorization may result in a hold for that amount on the associated Balance in Google Wallet. We cannot control, and are not responsible for, whether or when a merchant reverses that authorization to release the hold in that instance.
Please note that placing holds described in this section reduces the funds available in your Balance in Google Wallet and removing these holds increases the available funds in your Balance in Google Wallet. We are not responsible for damages or losses of any type, including wrongful dishonor, for any transaction that is not authorized because of a hold.
Other Restrictions
We may refuse to authorize or process any Balance in Google Wallet transaction for any reason, including if we believe there is not a sufficient balance in your Balance in Google Wallet to cover the requested transaction, the transaction would exceed the applicable transaction dollar amount, number or velocity limitations, violate sanctions prohibitions, potentially be a suspicious or high risk transaction or otherwise may violate any of the terms and conditions of these Terms. Alternatively, we may in our discretion authorize or process any of the foregoing types of transactions without incurring any obligation to authorize or process the same type of transaction on future occasions.
We may terminate your use of the Balance in Google Wallet at any time in our sole discretion, including if we believe that the Balance in Google Wallet is being used for any impermissible or illegal purposes. We reserve the right to add further restrictions to the use of a Balance in Google Wallet in our sole discretion and at any time.
(j) Balance in Google Wallet Transaction and Amount Limits
Regardless of what controls a Family Manager and Secondary Parent may impose on a Balance in Google Wallet, in no event can:
For security or other reasons, we may impose with or without notice to you other limits or restrictions on the amount or number of transactions a Supervised User can fund with their Balance in Google Wallet.
(k) Refunds And Returns
In the event that Pathward®, N.A., receives a refund from a merchant to your Card Account or chargeback on your behalf in connection with a GPBP Card transaction, you authorize us to credit your Balance in Google Wallet for the amount of the refund, upon GPC’s receipt of those funds from Pathward®, N.A. Please note that we have no control over when a merchant credits you for a refund, and the refund may not be available for a number of days after the date the refund transaction occurs.
(l) Supervision and Limits on Balance in Google Wallet Balances
Individuals with supervisory authority over Supervised Users in Google Family Link (the Family Manager and Secondary Parent (if one has been designated)), will have visibility into the Supervised User’s transaction activity in connection purchases funded by a Balance in Google Wallet and will be provided with certain tools described further below to impose limits on a Supervised User’s use of their Balance in Google Wallet. Purchases funded with a Balance in Google Wallet cannot be approved by the Family Manager or Secondary Parent in advance of the transaction.
By requesting to establish a Balance in Google Wallet, you authorize any Secondary Parent that you have designated in your Google Family Link profile to utilize these controls outlined herein. If you wish to remove the ability of the Secondary Parent to view information related to a Balance in Google Wallet or otherwise utilize supervisory tools related to the Balance in Google Wallet, including adjusting spending limits or locking/unlocking the Balance in Google Wallet, you must remove the Secondary Parent from your Google Family Link account.
We are not responsible for any disputes between the Family Manager and the Secondary Parent, including disputes that may pertain to custody and/or child support agreements, that may arise from a Balance in Google Wallet, including the use of supervisory tools we provide, including tools related to Balance in Google Wallet locks/unlocks and purchase limits.
Balance in Google Wallet Visibility
Family Managers and Secondary Parents will be able to view the Supervised User’s Balance in Google Wallet balance as well as associated transaction history and any locks or limits that have been placed on the Balance in Google Wallet through Google Family Link and any other platform we may make available, such as through https://wallet.google.com/, at no cost. We will also provide both the Family Manager and Secondary Parent with notifications in the event that funds are added to the Balance in Google Wallet, the Supervised User makes a purchase with a balance-linked GPBP Card, the Balance in Google Wallet is locked or unlocked, or any purchase limits are set, modified or otherwise removed or the Supervised User has reached their established spending limit.
Periodic Statements
Family Managers will be notified via email that a statement of activity related to any associated Balance in Google Wallet balances including related GPBP Card transaction activity, is available. Statements will be made available each month that transaction activity has occurred or may be issued quarterly, if no transaction activity has occurred on any associated Balance in Google Wallet balances. These statements can also be accessed at Google Family Link or https://wallet.google.com/.
Your Balance in Google Wallet balances will be deemed inactive if there has not been a transaction involving any of your Balance in Google Wallet balances within the prior six (6) months. You may be provided with a periodic statement if six (6) months have passed since your last transaction involving any of your Balance in Google Wallet balances. If your Balance in Google Wallet balances have become inactive because six (6) months have passed since there has been a transaction associated with any of these Balance in Google Wallet balances and your Google Pay account or Balance in Google Wallet balances have not been closed, your Balance in Google Wallet balances will be reactivated and periodic statements of transactions associated with your Balance in Google Wallet balances will again be provided to you following a transaction involving any of your Balance in Google Wallet balances, including the addition of funds to any of these Balance in Google Wallet balances or a transaction with a balance-linked payment method.
You, as the Family Manager, are responsible for reviewing statements we provide for accuracy and any errors. If you suspect there was an error in a transaction contact us as stated in our Customer Service and Error Resolution Policy. See the Cardholder Agreement for more information regarding errors in any GPBP Card transaction history.
It is your obligation to save or print a copy of your Balance in Google Wallet statement. If your access to one or more Services is cancelled or terminated by you or by us for any reason, you may not be permitted to access statements stored by GPC.
Transaction Receipts
The Family Manager and Secondary Parent will receive transaction receipts anytime funds are added to an associated Balance in Google Wallet. The Family Manager will also receive a transaction receipt anytime the Balance in Google Wallet is used to fund a GPBP Card for a purchase. Further, at the time of the purchase with a GPBP Card, the Supervised User should obtain a transaction receipt from the merchant in order to verify the transaction with the merchant. See Cardholder Agreement for more information.
You, as the Family Manager, are responsible for reviewing, retaining, verifying, and reconciling your transactions and receipts. If the receipt and our records conflict, our records will govern. If you suspect there was an error in a transaction involving your Balance in Google Wallet, contact us as stated in our Customer Service and Error Resolution Policy or if the error relates to a GPBP Card transaction, contact us as stated in the Error Resolution Procedures in the Cardholder Agreement.
Daily Spending Limits
The Family Manager and Secondary Parent can set limits on the amount of funds in a Supervised User’s Balance in Google Wallet that the Supervised User can use to fund purchases made with a balance-linked payment method within a twenty-four hour (24) period.
Once the established spending limit associated with the Balance in Google Wallet has been reached, the Supervised User will not be able to use the Balance in Google Wallet to fund tap to pay transactions using their GPBP Card until (a) the spending limit has been reset, or (b) the spending limit has been raised by either the Family Manager or the Secondary Parent. Spending limits reset at 12:00 AM in the time zone associated with the Family Manager’s address that is listed in their payments profile.
We will make commercially reasonable efforts to impose established spending limits on the associated Balance in Google Wallet as quickly as possible but there may be a brief delay between the limit being set and the limit being imposed on the Balance in Google Wallet balance. We are not responsible for reasonable delays in imposing spending limits on the Balance in Google Wallet balance.
There can only be one spending limit associated with a Balance in Google Wallet at any point in time. The Family Manager and Secondary Parent may raise, modify or otherwise remove spending limits placed on the Balance in Google Wallet. The last action taken by either the Family Manager or the Secondary Parent will govern the limit that will be imposed or, in the event that the limit is removed, not imposed, on the Balance in Google Wallet.
Balance in Google Wallet Locks
The Family Manager and Secondary Parent can choose to lock or unlock a Balance in Google Wallet. When a lock is placed on a Balance in Google Wallet, the funds underlying the Balance in Google Wallet will remain but the Supervised User will not be able to use the Balance in Google Wallet to fund a tap to pay transaction with a balance-linked payment method until the lock has been removed by either the Family Manager or the Secondary Parent.
We will make commercially reasonable efforts to impose locks and unlocks on the associated Balance in Google Wallet as quickly as possible but there may be a brief delay between the lock being set / removed and the lock being imposed or removed on the Balance in Google Wallet. We are not responsible for reasonable delays in imposing locks on or unlocking a Balance in Google Wallet.
Both the Family Manager and the Secondary Parent can lock or unlock the Balance in Google Wallet. The last action taken by either the Family Manager or the Secondary Parent with respect to the Balance in Google Wallet lock feature will govern whether or not a lock is imposed on the Balance in Google Wallet.
Removal of GPBP Card from Eligible Devices
The Family Manager and Secondary Parent can remove the GPBP Card from the Supervised User’s eligible device(s). Once the GPBP Card is removed from the Supervised User’s eligible device, the Supervised User cannot use the GPBP Card to make a purchase from the eligible device until the Family Manager or Secondary Parent re-adds the GPBP Card to the device.
(m) Supervised User’s Visibility Into Activity Involving the Balance in Google Wallet
Supervised Users will be able to view the following information related to the Balance in Google Wallet through Google Wallet at no cost: transaction history, current balance, whether the Balance in Google Wallet is locked or unlocked, any spending limits imposed on the Balance in Google Wallet as well as progress towards reaching a spending limit, if a spending limit has been imposed, and funds that have been added to the Balance in Google Wallet. Supervised Users will also receive notifications regarding certain activities related to the Balance in Google Wallet.
(n) Your Liability for Balance in Google Wallet Balances
You, as the Family Manager, are the legal owner of each Balance in Google Wallet that you request to create. As the owner of a Balance in Google Wallet, except as otherwise provided in these Terms, you, not the Supervised User, are liable for all transactions, fees, taxes, uses, liabilities, obligations and other activity that are incurred on your Balance in Google Wallet. See Exhibit C, Balance in Google Wallet Long Form Disclosures regarding any applicable fees.
By establishing a Balance in Google Wallet, the Family Manager authorizes the Supervised User to utilize the Balance in Google Wallet as discussed herein. You, as the Family Manager, are responsible for all transactions and associated fees and taxes incurred on your Balance in Google Wallet, including transactions by the Supervised User and other persons which you or the Supervised User have permitted to have access to the GPBP Card, GPBP Card number, PIN or other identifying information permitting access to the GPBP Card and Balance in Google Wallet.
Actions by Supervised Users must comply with these Terms and such actions will be attributed to you, as the Family Manager and owner of the Balance in Google Wallet. You are responsible for ensuring that associated Supervised Users comply with these Terms. In the event that a Supervised User violates these Terms, you will be held responsible in the same manner as if the action(s) were taken by you.
(o) Liability for Certain Balance in Google Wallet Transactions
We may restrict access to your Google Pay account, or Balance in Google Wallet temporarily or permanently if we notice potentially suspicious activity in connection with your use of the Service(s), or other potential violations of the Google Payment User Policies. We have no liability for restricting such access because of potential suspicious activity.
If we do not complete a transaction to your Card Account funded with your Balance in Google Wallet or other payment transaction on time or in the correct amount according to our agreement with you (other than for restrictions because of suspicious activity), we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
(i) If through no fault of ours, a merchant refuses to accept your GPBP Card or honor a transaction involving your Balance in Google Wallet;
(ii) If through no fault of ours, you do not have enough money available in your Balance in Google Wallet to fund a GPBP Card transaction;
(iii) If the terminal or system was not working properly, and you knew about the breakdown when you started the transaction using your GPBP Card;
(iv) If the transaction information supplied by you or a third party is incorrect or untimely;
(v) If circumstances beyond our control (such as flood, fire, loss of Internet connection, payment network outage or acts, omissions or directives of processors, financial institutions, payment networks or regulatory authorities) prevent a transaction, despite reasonable precautions that we have taken;
(vi) The merchant authorizes an amount greater than the purchase amount;
(vii) If access to or use of your GPBP Card or Google Pay account has been blocked after you reported your GPBP Card PIN or login credentials lost or stolen;
(viii) If there is a hold or your funds are subject to legal process or other encumbrance restricting their use;
(ix) If we have reason to believe the requested transaction is unauthorized;
(x) If the transaction is restricted by us or a financial institution because of potentially suspicious activity; or
(xi) If you are not a U.S. resident, do not create a Google Pay account or do not take any other required actions necessary to complete a transaction.
This list is not exhaustive. There may be other applicable exceptions as otherwise provided in our agreement with you or by state or federal laws.
(p) Customer Support Related to Your Balance in Google Wallet
In the event the Family Manager or Supervised User has a complaint or issue with the Balance in Google Wallet or would like to allege that an error occurred, including an unauthorized transaction, the Family Manager is the only individual that may file a report regarding an issue with a Balance in Google Wallet transaction through the Balance in Google Wallet’ transaction history view available in https://wallet.google.com/ or contact our customer service via our Contact Us page, by calling us at 1-888-986-7944, or writing to us at Google Payment Corp. – Complaints Handling, P.O. Box 727, Mountain View, CA 94042. A Supervised User or Secondary Parent is not permitted to communicate with customer support or file a complaint related to the use of a Balance in Google Wallet.
If you, as the Family Manager, allege that an error occurred in connection with a transaction involving your Balance in Google Wallet and are entitled to a credit in connection with an investigation, the credited funds will be transferred to your Card Account (if the transaction was initiated with a GPBP Card) and then added to the Balance in Google Wallet, if your Card Account (as applicable) and Balance in Google Wallet are still opened.
It is the Family Manager’s responsibility to promptly review statements and transaction history related to the Balance in Google Wallet and to contact us immediately in the event that they have any questions or concerns. We are not responsible for supervising the activities of Supervised Users that use their Balance in Google Wallet to fund transactions initiated with their GPBP Card.
Further information regarding our complaint handling practices is contained in our Customer Service and Error Resolution Policy.
(q) Customer Support Related to Your GPBP Card and Card Account
In the event the Family Manager or Supervised User has a complaint or issue with your Card Account or GPBP Card or would like to allege that an error occurred, including an unauthorized transaction, all such disputes and complaints should be communicated by the Family Manager, as specified in the Cardholder Agreement.
(r) Closure of Your Balance in Google Wallet
You, as a Family Manager, or an associated Supervised User may choose to close a Balance in Google Wallet balance through Google Family Link or https://wallet.google.com/ or through any other methods we may establish from time to time. You may close a Balance in Google Wallet balance by logging into wallet.google.com, selecting the “Family” tab, viewing the Supervised User’s Balance in Google Wallet and selecting the “close balance” option.
Your ability to close a Balance in Google Wallet is contingent on your ability to meet certain conditions that we may establish. For example, if a Balance in Google Wallet has a negative balance, we may limit your ability to close your Balance in Google Wallet and may initiate a debit or charge to your Funding Account(s) to resolve the negative balance.
We reserve the right to close your Balance in Google Wallet at our sole discretion, including if we suspect that you or a Supervised User have violated these Terms. Your request for your Balance in Google Wallet closure will not affect any of our rights or your obligations arising under these Terms prior to our acting upon your request.
If the Family Manager closes their Google Pay account, payments profile, Google account, or Google Family Link account, any Balance in Google Wallet balances associated with the Family Manager will be promptly closed. If a Supervised User closes their Google Pay account, payments profile, or Google account, or removes parental supervision from their Google account, the Balance in Google Wallet balance associated with that Supervised User will be closed. A Balance in Google Wallet will be promptly closed in the event that there is no Supervised User associated with the Balance in Google Wallet or an associated Supervised User is no longer associated with the Family Manager’s Google Family Link account.
When you close your Balance in Google Wallet, the GPBP Card and associated Card Account will also be closed. When you close your GPBP Card and associated Card Account, your Balance in Google Wallet will also be closed. See the Cardholder Agreement for information related to the cancellation of your GPBP Card and Card Account.
(s) Treatment of Funds Remaining in Balance in Google Wallet Upon Closure
Upon closure of the Balance in Google Wallet, any funds remaining in the Balance in Google Wallet will be returned to the owner of the Balance in Google Wallet (the Family Manager). If a Payment Method that was used by the Family Manager to fund the associated Balance in Google Wallet is still active in the Family Manager’s payments profile, you, as the Family Manager, authorize us to attempt to return any remaining funds to the Payment Method. In the event that you have multiple active Payment Methods, we reserve the right to select the Payment Method we return your remaining funds to. If the Family Manager does not have an active Payment Method in their payments profile that was used to fund the associated Balance in Google Wallet or we are otherwise unable to return the funds to your Payment Method, you, as the Family Manager, authorize us to create and maintain any remaining funds in a limited-purpose disbursement account. Funds received and held by us in a disbursement account do not represent a store of value, and you may not access or use any such funds except to withdraw the funds to your ACH-enabled checking or savings account via the ACH network or checking account using your debit card.
Funds remaining in your Balance in Google Wallet upon closure are not permitted to be returned to any Google Pay Balance.
Return of funds to the Family Manager’s Payment Methods or other external accounts that may be specified upon closure of your Balance in Google Wallet may be processed in part by third parties (such as the Family Manager’s account-holding bank). We are not responsible for returned funds once provided to the third party for delivery to you. GPC charges no fees to return funds to ACH-enabled checking or savings accounts, or debit cards. See Exhibit C, Balance in Google Wallet Long Form Disclosures regarding any applicable fees. You are solely responsible for any fees that may be charged to you by a third party for processing a return of funds. GPC will not be responsible for return of funds provided to the wrong party or account, or where you provided incorrect account details to GPC.
(t) Graduation of Balance in Google Wallet
Once a Balance in Google Wallet has been created, there is no process through which ownership of the Balance in Google Wallet can be transferred from the Family Manager to the Supervised User. Rather, a Supervised User that desires to create and maintain a Google Pay Balance, which is available to eligible persons age eighteen (18) and above, must request to close the Balance in Google Wallet of which the Supervised User is an authorized user of, and initiate the Google Pay Balance creation process.
When the Supervised User or Family Manager requests to close a Balance in Google Wallet, funds remaining in the Balance in Google Wallet will be provided to the Family Manager.

The Google Play Gift Card and Prepaid Play Balance Terms of Service apply to Google Play Gift Cards and prepaid Play balances including redeemed Google Play gift cards, credits or gift codes. When you initiate a payment transaction using a Service where GPC processes the payment on behalf of a Third Party (a “Processing Service”), GPC will charge your Payment Method on behalf of and as agent of the Third Party. GPC will assist, as agent of the Third Party, in accessing a payment network and processing the payment transaction. Once your Payment Method is authorized, your payment obligation to the Third Party shall be deemed completed and discharged, except for your obligations in the event of a chargeback or other reversal.
Depending on the nature of the Third Party, such payment transactions may be for the purchase of goods or services initiated in person at the Third Party’s location or through an online transaction such as via the Third Party’s website or app. When you initiate a Third Party payment transaction processed by GPC, you authorize the Third Party to charge or debit your Payment Method via the Processing Service as necessary to complete the transaction.
You also authorize any crediting to your Payment Method in connection with reversals, refunds or adjustments related to a transaction processed through the Processing Service. You also agree that a Third Party and GPC, acting on behalf of the Third Party, may resubmit a payment transaction to a payment network for processing one or more times in the event that a prior payment transaction via the Processing Service is declined or returned by the payment network.
Purchases made through the Processing Service are also subject to your Payment Method issuer’s terms and conditions. You are responsible for any charges and related fees that may be imposed under the Payment Method terms and conditions as a result of your use of a Payment Method for a transaction processed by the Processing Service.

Google also may share information such as a phone number, billing, delivery or email address saved in your Google Account with GPC for GPC to provide to the Third Party or Google may provide that information directly to the Third Party, where relevant to completing the transaction.
You acknowledge and agree that your payments processed through the Processing Service are solely between you and the Third Party, and not with GPC, Google or any of their affiliates. You should contact the Third Party regarding any issues with the goods or services for which payment was processed through the Processing Service. GPC, Google and their affiliates are not a party to your transactions processed through the Processing Service.
For details or terms relating to a specific transaction processed through the Processing Service, including refund or dispute resolution policies, please refer to the terms of service, help center or other support materials provided by the Third Party with which you transacted.
This Section of the Terms (titled “Subscription Purchases And Other Recurring Payments”) only applies to you if you authorize subscription purchases or other recurring payments.
Authorization to Charge your Payment Method
By saving a payment method to your Google Account, you authorize GPC and/or the Seller (as applicable) to charge the saved Payment Method (1) for each payment that becomes due with respect to any subscription or other recurring payment obligation for which you have chosen the Payment Method as the primary means of payment and (2) in the event your chosen Payment Method is unable to be charged in full for any subscription or other recurring payment obligation for any reason, any remaining amount due.
Authorization of Recurring Payment
In the event that you sign up for a subscription or other recurring payment you have authorized in advance to recur at substantially regular intervals which is processed by GPC (“Recurring Payment”), your Recurring Payment will start when you click “Accept & Buy” or equivalent phrase. This will be a recurring billing transaction. Unless otherwise stated, your Recurring Payment authorization will continue indefinitely until you cancel the Recurring Payment.
By clicking “Accept & Buy” or equivalent phrase, you authorize GPC and/or the Seller (as applicable) to automatically bill your chosen Payment Method each designated billing period for the Recurring Payment at the agreed amount. If your chosen Payment Method cannot be charged in full for any reason, you authorize GPC and/or the Seller (as applicable) to charge any backup Payment Method(s) saved to your Google Account for any remaining amount (up to the full amount of the required payment) in any order, at GPC’s or the Seller’s discretion.
The Recurring Payment amount will continue to be charged to your Payment Method, or backup Payment Method(s), each billing period until you cancel your Recurring Payment, unless otherwise stated in the terms and conditions accompanying your Recurring Payment. The billing rate is subject to change during the subscription/recurring period.
Your Payment Method, or backup Payment Method(s), will be billed each period on or after the date agreed upon in the terms and conditions accompanying your Recurring Payment.
You may cancel a Recurring Payment at any time by following the process described here or the terms and conditions accompanying your Recurring Payment. Cancellation may not become effective until the end of the current billing period unless otherwise specified. If you remove all saved payment methods from your Google Account, but do not cancel the underlying Recurring Payment, you may continue to owe any amounts for billing periods in which the Recurring Payment is active, even if we cannot charge your Payment Methods when such amounts become due.
If the Recurring Payment may vary in amount, GPC or the Seller (as applicable) will tell you ten (10) days before each payment when the payment will be made and how much it will be. You may choose instead to get this notice only when the payment will differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set, if we provide that option. We reserve the right to issue refunds or credits of Recurring Payments at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
You also may stop a Recurring Payment to be charged to your Payment Method that is a debit card or that debits or charges your bank account (automated clearing house payment (ACH)-enabled) or other Payment Method specified in the terms and conditions accompanying your Recurring Payment. Contact us as indicated here in time for us to receive your stop payment request three (3) business days or more before the payment you want stopped is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within fourteen (14) days after you call. If you order us to stop a Recurring Payment three (3) business days or more before the payment is scheduled and we do not do so, we will be liable for your losses or damages.

We may limit or suspend your use of one or more Services at any time, in our sole and absolute discretion. If we suspend your use of a Service, we will attempt to notify you by electronic mail.
