Subscribe with Google (“SwG”) To use SwG, you must accept (1) the Google Terms of Service, and (2) these SwG Additional Terms of Service (the “SwG Additional Terms”) during the purchase process.

Please read each of these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.

Unless you are a consumer based in France, if these SwG Additional Terms conflict with the Google Terms of Service, these SwG Additional Terms will govern for SwG.

Although it’s not a part of these Terms, we encourage you to read our Privacy Policy to better understand how you can update, manage, export, and delete your information.

You can view, copy, and store these terms in PDF format during your purchase. We do not save a copy of this contract.

  1. Your Use of SwG

Use of the Service. You may use SwG to access publications (“Publications”), manage subscriptions (“Subscriptions”) to those Publications, each made available by third-party publishers (“Publishers”), and access certain premium features or content in exchange for a one-time or recurring fee (each a “Paid Service” and collectively the “Paid Services”). The Paid Services include personalization, stickers, and other SwG services which may be offered by Google. Please be aware that such third parties are not affiliated with Google, and Google does not endorse any Publications made available through SwG that originate from a source other than Google. When you use SwG, Google will be your contractual partner to any Paid Services you have purchased. The Google entity that sells and provides SwG to you and that you’re contracting with, is the entity corresponding to your billing address as follows:

Age Requirements. In order to use SwG, you must have a valid Google Account. You can learn how to create a Google Account in the Google Terms of Service.

You must comply with any additional age requirements that might be stated to apply for the use of specific Subscriptions or features on SwG.

Third-Party Fees. You are responsible for any access or data fees incurred from third parties (such as your internet provider or mobile carrier) in connection with your use of SwG.

Information about You. Google's privacy policies explain how we treat your personal data and protect your privacy when using SwG. Google may need to provide your personal information, such as your name and email address, to Publishers for the purposes of processing your transactions, provisioning Paid Services to you, or communicating to you about your account. You may also be asked to provide information directly to the Publisher during your account creation. Publishers agree to use this information in accordance with their privacy policies.

Changes to these Terms. Any changes to these terms will be handled as described in the Google Terms of Service.

  1. Purchases and Payments

Google Payments. In order to purchase Paid Services through SwG, you must have a Google Payments account and agree to the Google Payments Terms of Service. The Google Payments Privacy Notice applies whenever you purchase Paid Services using a Google Payments account. You are responsible for all amounts payable associated with purchases made through SwG on your Google Payments account. If these SwG Additional Terms conflict with the Google Payments Terms of Service, these SwG Additional Terms will govern.

Taxes. “Taxes” means any duties, customs fees, levies or taxes (other than income tax) associated with the sale of Paid Services, including any related penalties or interest. You are responsible for any Taxes and must pay for Paid Services without any reduction for Taxes.

Refunds and Right of Withdrawal. See SwG's Refund Policy for more information about your rights to withdraw, cancel, or return purchases for a refund. Except for as expressly set out in SwG's Refund Policies or if you have a right of withdrawal as explained below in Section 3, all sales are final, and no returns, replacements or refunds are permitted. If a replacement, return or refund is granted for any transaction, the transaction may be reversed, and you may no longer be able to access the Paid Services that you acquired through that transaction.

Subscriptions. Subscriptions are automatically charged each billing period (whether weekly, monthly, annually, or another period), and you may be charged no more than 24 hours before the beginning of each billing period. The relevant billing period will be displayed to you before purchasing a Subscription.

(a) Trial Periods. When you subscribe to Subscriptions for a price, you may receive access to the subscription benefits at no charge for a specified trial period, after which you will be charged until you cancel your Subscription. To avoid being charged, you must cancel before the end of the trial period. Once you cancel your trial, you will lose any Subscription privileges at the end of the trial period. Access to such trial periods may be limited to a certain number of trials for each user during a given period, or other restrictions. Where a trial period is offered, you will be informed about the trial details and the cancellation process before you purchase the Subscription.

(b) Cancellations. You may cancel a Subscription at any time before the end of the applicable billing period as described in the Help Center, and the cancellation will apply to the next period. For example, if you purchase a monthly Subscription, you may cancel that Subscription at any time during any month of the Subscription, and the Subscription will be canceled as of the following month. You will not receive a refund for the current billing period, except if you have a Right of Withdrawal as described in Section 3 or as otherwise provided in SwG's Refund Policy (for example where Subscription is defective). You will continue to receive Subscriptions and updates (if applicable) of the relevant Subscription during the remainder of the current billing period.

(c) Price Changes. When you purchase a Subscription, you will initially be charged at the rate shown to you at the time of your agreement to subscribe. We may increase the price of the Subscription based on price changes from the Publisher, as long as the increase is reasonable, taking into account your interests and Google’s interests. Google will notify you at least six weeks in advance of any price increase. The price increase will apply to the next payment due from you after the notice, provided that you have been given at least six weeks’ prior notice before the charge is made. If you are given less than six weeks’ prior notice, the price increase will not apply until the payment after the next payment due. If you do not wish to pay the increased price for a Subscription, you may cancel the Subscription as described in the Cancelations section of these Terms, and you will not be charged further amounts for the Subscription. If you do not object to the price increase before it takes effect by canceling your Subscription, you will be deemed to have accepted the increased price. Where the Publisher increases the price of a subscription and consent is required, Google may cancel your subscription unless you agree to the new price.

  1. EEA Consumer Right of Withdrawal

If you are a consumer based in the EEA, and you are purchasing Subscriptions as a consumer, consumer law gives you the right to withdraw from the contract as described below.

Right of Withdrawal.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can contact us by email at play-eu-support@google.com; by phone (see below for country-specific telephone numbers); or by writing to us at Google Commerce Limited, c/o Customer Support, Gordon House, Barrow Street, Dublin 4, Ireland. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal.

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

  1. Additional Terms

Suspending or terminating your access. Google may terminate or suspend your access to SwG and/or the Paid Services for any of the reasons described in the Google Terms of Service, which includes if you materially or repeatedly breach any of the Google Terms of Service, these SwG Additional Terms, or the Google Payments User Policy. Before taking action to suspend or terminate your access, Google will provide you with advance notice when reasonably possible, as described in the Google Terms of Service and will give you the chance to comment on your alleged breach. If the breach is not confirmed, Google will restore your access.

Restrictions: In addition to following the basic rules of conduct described in the Google Terms of Service, you may not:
