Additional Google Pay/Google Payments Terms of Service

1. Introduction

Google Payments (also known as 'Google Pay') is a service offered by Google Ireland Limited ('Google', 'we', 'us' or 'our'), ​​based at Gordon House, Barrow Street, Dublin 4, Ireland.

If you want to use Google Pay, you must agree to (1) the Google Terms of Service and (2) these Google Pay/Google Payments Additional Terms of Service (the 'Additional Terms').

Read each of these documents carefully. Together, they are referred to as the 'Terms'. They determine what you can expect from us when using our services and what we expect from you. For example, the Google Terms of Service contain conditions such as the right of withdrawal, the statutory warranty of conformity, and more information about the reasons why we make changes to our services, as well as the prior notice we provide to you regarding these changes. Please note that the Google Terms of Service apply to the storage and use of items such as customer cards, loyalty program cards, transit cards, boarding passes, and other items that you cannot pay for.

If these Additional Terms conflict with Google's Terms of Service, these Additional Terms apply to Google Pay.

Although not part of these terms, the Google Payments Privacy Statement describes how Google handles your payment data. We recommend reading this statement to better understand how we manage your data.

Certain features of Google Pay were formerly known as 'Android Pay'. While you may see older references to Android Pay in stores, in apps, or on websites, these Terms apply to those features.

Some products and features may not be available in all countries. Go to the Google Pay Help Center for more information.

You can terminate the Google Pay service at any time by contacting Google Payments or by following these steps.

2. Standard requirements

If you want to use Google Pay, you must:

These factors may affect your use of Google Pay as well as the performance of Google Pay. Such system requirements are your responsibility.

With Google Pay, you can store the items below in your Google account, manage them in a single place, and make transactions with Google and third parties that use them:

4. Payment methods

(a) Types of Payment Methods

With Google Pay, you can store and manage various types of payment methods in your Google account (collectively 'Payment methods'), including:

The availability of a particular Payment Method or its compatibility with Google Pay may depend on the country in which you live and other factors. The eligible types of Payment Methods, as well as the use of the Payment Methods and the features of Google Pay described below, may not be available everywhere and may change at any time (in which case we will notify you if required pursuant to the section 'Developing, improving, and updating Google services' in the Google Terms of Service).

(b) Save a Payment Method

You may be able to save a Payment Method to your Google account via various user interfaces, including the Google Pay website, the Google Chrome browser, the Payment Method issuer's app or website, or a Google product or service, such as the Google Play Store. If you want to save a Payment Method, you must complete all required information on any registration forms you are shown. The information you provide must be current, complete, and accurate, and you must keep it that way. We may ask you to provide additional information as a condition for continuing to use Google Pay or to help us determine whether you may continue to use Google Pay.

If you save a Payment Method, Google may store information about the Payment Method, such as your name and billing address. With Google Pay, you can also store other information in your Google account that can help speed up transactions, such as a shipping address.

You authorize us to verify the good standing of your Payment Method with its issuer, for example by submitting a payment authorization request and/or debiting and/or crediting a small amount via the Payment Method in accordance with the network rules or other requirements applicable to the Payment Method.

You agree that Google Pay is intended for personal use with your own Payment Methods. If you use Google Pay with a suitable business payment card, you confirm that you are doing so with the approval of your employer and with the authority to bind your employer to these Terms.

(c) The role of Google

Except when Google or its affiliated entity is the card issuer, neither Google nor its affiliated entities are parties to the cardholder agreements, privacy policy, or other terms of use of your Payment Methods. Nothing in these Terms modifies the terms of the card issuer. In the event of any inconsistency between these Terms and the terms or privacy policy of your card issuer, these Terms shall apply to the relationship between you and Google regarding Google Pay, and the terms of your card issuer shall apply to the relationship between you and the card issuer. Google provides no guarantees nor verifies whether your Payment Methods are in good standing or whether the card issuer of your Payment Methods approves or authorizes a transaction with a merchant if you use Google Pay for that transaction.

Except where Google or its affiliated entity is the issuer, neither Google nor its affiliated entities are involved in providing credit or determining creditworthiness, nor do they exercise control over the availability or accuracy of Payment Methods or funds, the provision (or addition) of Payment Methods to Google Pay, or the addition of funds to Payment Method balances. For questions regarding the foregoing, please contact the issuer of your Payment Method.

(d) Store a Virtual Card Number or Linked Third-Party Account

The following additional terms apply if you use Google Pay to store a Virtual Card Number or Linked Third-Party Account in your Google account.

After you have started adding a Payment Method to Google Pay and have provided the information requested by Google and/or the issuer of your Payment Method, Google Pay checks whether the Payment Method is eligible for use with Google Pay. Not all Payment Methods from a participating issuer may be eligible. If the issuer of your Payment Method supports Google Pay and your Payment Method is eligible, you may see a screen asking you to accept the issuer's terms and conditions when you add the Payment Method. Once you have done so and added the Payment Method, Google stores a Virtual Card Number that represents the actual card number of your Payment Method or links your Linked Third-Party Account to your Google Account for use as described in Article 5 below.

Virtual card numbers that you register via Google Pay differ from any linked Payment Cards that you store in your Google account. Unlike a Virtual card number, you typically do not see a card image of the Payment Card that resembles the corresponding physical card, and it cannot be used for transactions in stores with Near Field Communication ('NFC'). If you register a Virtual card number, Google Pay may also store the linked Payment Card in your Google account.

You agree that Google Pay may receive information from your Payment Method issuer to display transaction details in RTF format and your recent transaction history in Google Pay.

(e) Remove payment methods

A Payment Method may be removed from Google Pay on a specific device and no longer be usable with the Service if: (i) you remove the Payment Method from Google Pay, (ii) you remove the Payment Method from your Google account, (iii) you erase your mobile device using Android Device Manager, (iv) you delete your Google account, (v) your mobile device has not been connected to a Google product or service for ninety (90) consecutive days, (vi) you have not used Google Pay on the device for twelve (12) consecutive months, and/or (vii) your Payment Method issuer or your payment network instructs Google to remove the Payment Method from Google Pay.

5. Performing transactions with Payment Methods

(a) In Google services

With Google Pay, you may also be able to initiate a payment transaction with a 'Seller', defined as (i) a Google affiliated entity or (ii) another seller participating in one or more of Google's marketplaces ( listed here ) that offers merchandise, goods, or services for sale to you, and that requests Google or one of its affiliated entities to process payment transactions on behalf of the Seller.

You acknowledge and agree that your transaction with a Seller (a "Google Transaction") takes place exclusively between you and the Seller. Google and its affiliates are not parties to your Google Transactions and associated purchases, nor are they the buyer or seller of any Google Transaction unless expressly stated otherwise (for example, in the listing or description of the relevant merchandise, goods, or services on a Google website or interface).

When you initiate a Google transaction, Google may show you the Payment methods available to you at the time of the transaction. After you have selected the desired Payment method, Google charges the amount to that Payment method or shares the Payment method and associated data with one of its affiliated entities, which then processes the transaction on behalf of the Seller. You authorize the debiting of your Payment method as necessary to process a Google transaction. You also authorize the debiting of your Payment method in connection with chargebacks, refunds, or corrections regarding a Google transaction.

For more information or terms regarding a specific Google transaction, including refunds or dispute resolution, please refer to the Terms of Service, the Help Center, or other support materials from the Seller with whom you completed a transaction.

If there is a problem charging the costs to your selected Payment Method, Google may charge the costs to another valid Payment Method you have saved in Google Pay. Go to the Google Pay website , Google Pay app, or Google Settings on your Android device to manage your payment options. You also agree that a Merchant may resubmit a Google transaction for a purchase to the payment network to be processed again or multiple times in the event that a previous Google transaction is declined or returned by the payment network. Google may delay, hold, cancel, or reverse payment processing of suspicious transactions or transactions that may involve fraud or misconduct, or that violate applicable law, the Terms, or other applicable Google policies, as determined solely at Google's discretion.

If a Seller offers you the option to pay for subscriptions, your subscription begins the moment you click Agree and pay (or similar text) during a subscription purchase. This is a recurring billing transaction. Unless otherwise stated, your subscription and the relevant billing authorization continue indefinitely until you cancel them. By clicking Agree and pay (or similar text), you authorize the Seller to charge the subscription costs to your chosen Payment Method during each designated billing period. The amount of the Google transaction may be changed by the Seller during the subscription period. Cancellation of a subscription does not take effect until the end of the current billing period. You will not receive a refund for the current billing period and will retain access to the relevant subscription for the remainder of the current billing period. If these subscription terms conflict with the Seller's subscription terms, the Seller's terms apply to the relevant subscription.

(b) With Third Parties

If you initiate a payment via Google Pay with a party other than a Seller (such a party is a 'Third Party' and such a transaction is a 'Third Party Transaction'), Google may provide data about your Payment Method and related information to that Third Party so that it can charge your Payment Method. Depending on the nature of the Third Party, a Third Party Transaction may take place for the purchase of goods or services, or for other purposes, such as a donation to a charity or a gift. A Third Party Transaction can be initiated as follows: you use tap and pay in stores via NFC, barcodes, or other contactless technologies; you select Google Pay or Pay with Google Pay as a payment option in an online transaction on a Third Party's website or app; or you interact with a Third Party via another online interface, such as via Google Assistant. If you initiate an online transaction, Google Pay may also share other information, such as a billing, shipping, or email address stored in your Google account, if necessary to complete the transaction.

In the case of a Transaction with a third party, Google is no longer involved in the transaction after the Payment Method and other data have been shared with the Third Party, and you acknowledge and agree that such transaction is exclusively between you and the Third Party and not between you and Google or its affiliated entities. You must contact the Third Party or the provider of your Payment Method (such as the issuer of your Payment Card) directly for issues with a Transaction with a third party, including refunds and disputes.

When you visit a participating third party's website or app, Google may disclose to the third party whether or not you have Google Pay set up on your device if requested by the third party, so that the third party knows whether to offer you Google Pay as a payment option. However, you may still see the Google Pay payment option on a third party’s website or app if the third party offers Google Pay as a payment option to all users. You can opt out of Google making this disclosure in Google Pay privacy settings. Opting out could affect your ability to use Google Pay with certain third parties. If you’re under the age required to manage your own Google Account, this does not apply to you and Google won’t disclose your information for this purpose.

(c) As part of AutoFill in Chrome or Android

If you have enabled the AutoFill feature in the Google Chrome browser or on your Android device, Google Pay may also offer you the option to automatically fill in your saved Payment Method and address details on a payment form on a third-party website in the Chrome browser or on a payment form in a third-party app on an Android device. (For more information on how AutoFill works with Google Pay, go to the Chrome Help Center.) When you use this feature, Google does not interact with the Third Party's website or app, and only your request to automatically fill in certain selected information on a Third Party form is executed. Google is not involved in transactions you conduct using AutoFill in Chrome or Android, and you acknowledge and agree that such a transaction takes place exclusively between you and the Third Party and not between you and Google or its affiliates. You must contact the Third Party or your Payment Method issuer directly regarding issues with a transaction where you used AutoFill in Chrome or Android.
